I FLUSSI INFORMATIVI NELLA CRISI DI GRUPPO

Il lavoro tratta dei flussi informativi fra i soggetti che ricprano specifiche funzioni nelle procedure di risanamento che coinvolgono società appartenenti a un gruppo. This article examines information flows in the insolvency of enterprise groups and, in particular, the disclosure of information between the people, who hold functions in the procedures relating the single companies of the group. This work considers the rules about the above mentioned matter provided for in the part. three of the Uncitral legislative guide on the insolvency law (treatment of the enterprise groups in the insolvency), in the Regulation 2015/848 of the European Parliament and of the Council on insolvency proceedings (recast), in the new German government bill concerning the reform of the InsO - which has yet to be adopted by German Parliament - and, at last, in the German Inso in forceThis article examines information flows in the insolvency of enterprise groups and, in particular, the disclosure of information between the people, who hold functions in the procedures relating the single companies of the group.
