La Corte costituzionale guarda sempre più spesso alle spiegazioni che supportano i bilanciamenti fra diritti e valori soprattutto quando, nel contesto della crisi economica, le soluzioni prospettate pongano problemi di rispetto del nucleo incomprimibile dei diritti sociali a fronte di risorse ancor più limitate: anzi, in taluni casi e analogamente a quanto verificatosi in altri ambiti, la Corte invita espressamente il legislatore a motivare le proprie scelte. L’analisi svolta consente di valutare anche le conferme e gli arricchimenti introdotti dalla Corte costituzionale in tema di tutela dei diritti sociali nel rispetto del principio dell’equilibrio di bilancio: ossia, entro quali limiti i caratteri della forma di stato possono essere ponderati con i principi desumibili dall’art. 81 della Costituzione. Il contributo evidenzia come la crisi e le ridotte disponibilità economiche possano costituire l’occasione per ripensare anche le forme di tutela dei diritti. Inoltre, mostra come la tesi dell’Autrice sull’obbligo di motivazione delle leggi trovi sempre più spesso delle conferme nella giurisprudenza della Corte costituzionale. The Constitutional Court looks more and more often to the explanations that support the balances between rights and values especially when, in the context of the economic crisis, the proposed solutions pose problems of respect for the incompressible core of social rights in the face of even more limited resources: in some cases and similarly to what occurred in other areas, the Court expressly invites the legislator to justify the choices made. In particular, this essay highlights the confirmations and enrichments introduced by the Constitutional Court regarding the protection of social rights in compliance with the principle of budget balance: that is, within what limits the characteristics of the form of state can be weighted with the principles inferable from art. 81 of the Constitution. In addition, this essay underlines how the crisis and reduced economic resources can be an opportunity to rethink the forms of protection of rights. In addition, it shows how the author's thesis on the obligation to justify the laws finds more and more confirmation in the case of law of the Constitutional Court.
