Famiglie e minore età: dall'atto al rapporto.

Il volume ripercorre l’evoluzione della famiglia e della filiazione dall’introduzione del divorzio a oggi, segnalando un tratto ricostruttivo comune: la centralità del rapporto rispetto all’atto. Attraverso questa chiave di lettura si affrontano alcuni tra i più significativi problemi del nostro tempo: l’effettività dei doveri derivanti dal matrimonio e dall’unione civile, l’incidenza dei diritti del figlio sull’esercizio della responsabilità genitoriale, il bilanciamento tra il favor veritatis e il favor stabilitatis nella filiazione, la rilevanza della genitorialità sociale e della parentela di fatto e lo stato di figlio dei nati da una tecnica procreativa vietata in Italia. Emerge una nozione di famiglia, di genitorialità e di filiazione caratterizzata dalla preminenza del rapporto rispetto all’atto costitutivo, al legame genetico e all’eterosessualità. The volume traces the evolution of the family and filiation from the introduction of divorce to today, highlighting a common reconstructive feature: the centrality of the relationship with respect to the act. Through this interpretation, some of the most significant problems of our time are addressed: the effectiveness of the duties deriving from marriage and civil union, the impact of the rights of the child on the exercise of parental responsibility, the balance between the veritatis and the favor stabilitatis in filiation, the relevance of social parenting and de facto kinship and the status of child of those born from a procreative technique prohibited in Italy. A notion of family, parenting and filiation emerges characterized by the pre-eminence of the relationship over the act, the genetic link and heterosexuality.
