Leges maluerunt: origine del diritto ed evoluzione giuspolitica in Tac. Ann. III, 25-28

The contribution offers a political and diachronic interpretation of the excursus on the history of law from Tacitus, Annals III, 25-28, considering it also on the basis of literary passages from different sources regarding similar subjects. In this light, it also devotes special attention to the role attributed to Augustus in the decline of the Roman legal system and to Tiberius’ conception of law reflected by other passages from Tacitus’ Annals. The historian’s arguments on these aspects lead us to believe that even through this excursus he meant to offer an analysis of the relationship between law and Emperor’s authority and therefore to invite those in power in the first decades of the II century A. D. to respect the traditional juridical institutions of the res publica, in opposition to the autocratic administration of justice which had prevailed in the Flavian Age. --- Il contributo propone un’interpretazione in chiave politica e diacronica dell’excursus sulla storia del diritto in Tacito, Annales, III, 25-28, prendendolo in considerazione anche alla luce di ulteriori contesti letterari riguardanti il medesimo argomento, tratti da fonti diverse. In quest’ottica, esso dedica inoltre particolare attenzione al ruolo attribuito ad Augusto nel processo di declino del sistema legale romano e alla concezione della legge di Tiberio di cui si coglie il riflesso in altri passi degli Annales di Tacito. Le argomentazioni dello storico su questi temi portano a ritenere che anche attraverso l’excursus in esame egli intendesse offrire un’analisi delle relazioni tra diritto e autorità imperiale e che dunque volesse invitare i soggetti al potere nelle prime decadi del II secolo d. C. a rispettare le tradizionali istituzioni giuridiche della res publica, contrapponendosi a quell’amministrazione autocratica della giustizia che era stata predominante nell’età Flavia.
