V.E. Orlando costituente

V.E. Orlando costituente dovrebbe essere, in linea di principio, un ossimoro. Nella sua teoria dello Stato, infatti, non c'era mai stato posto nè per il potere costituente, nè per i partiti politici che della carta repubblicana furono gli autori. Ed egli non mancò infatti di sollevare critiche al testo costituzionale. Ma analizzando meglio i suoi interventi in assemblea, la realtà si rilvela molto diversa. Orlando partecipò al dibattito costruttivamente e convintamente, trovandosi perfettamente a proprio agio in quel contesto. Il saggio vuole dunque ricercare nel pensiero dell'autore le ragioni del suo atteggiamento propositivo nel consesso costituente, per scoprire che questo ruotava attorno a due concetti: la centralità del Parlamento e la storicità del diritto. V.E. Orlando as constituent should be, in principle, an oxymoron. In his theory of state there had never been a place for constituent power or for the political parties that were the authors of the republican charter. And he did not fail to find defects in the constitutional text. But by analyzing better his interventions in the assembly, the reality turns out to be very different. Orlando participated in the debate constructively and with conviction, being perfectly at ease in that context. The essay therefore aims to seek in the author's thought the reasons for his propositional attitude in the constituent assembly, to discover that it was based on two concepts: the centrality of Parliament and the historicity of law.
