La rilevanza della filiazione non genetica.

Recenti interventi legislativi e giurisprudenziali mostrano come, in tema di filiazione, accanto al favor veritatis debba riconoscersi la rilevanza giuridica del rapporto con il minore. Una rilevanza che prescinde dalla derivazione genetica, dal parto e dall’eterosessualità di chi abbia assunto, in fatto o in diritto, il ruolo di genitore. Si impone, perciò, una ricostruzione dell’ordine pubblico della filiazione, in cui emerge la necessità di bilanciare il valore della verità con l’interesse concreto del minore. Un interesse che può consistere nella conservazione dello stato di figlio non veritiero o nella costituzione, tramite l’adozione in casi particolari, della filiazione con un soggetto dello stesso sesso del genitore o, ancora, nel riconoscimento di provvedimenti stranieri. Tutto ciò porta a scorgere la complessità del fondamento della filiazione, oltre il dato genetico. Il saggio cerca di favorire la circolazione dello status filiationis, mostrando come sia in atto un processo di avvicinamento degli ordinamenti. Ciò potrebbe avere un'influenza sulla comunità scientifica internazionale in funzione di un incremento della circolazione delle famiglie e dell'attuazione di diritti fondamentali. Recent legislative and jurisprudential interventions show how, with regard to filiation, alongside the favor veritatis must recognize the legal relevance of the relationship with the minor. A relevance that regardless of the genetic derivation, the birth and the heterosexuality of those who have assumed, in fact or in law, the role of parent. It is therefore necessary to reconstruct the public order of filiation, in which the need to balance the value of truth with the concrete interest of the minor emerges. An interest that may consist in the preservation of the untrue status filiationis or in the constitution, through the adoption in particular cases, of filiation with a subject of the same sex of the parent or, again, in the recognition of foreign provisions. All this leads to see the complexity of the foundation of filiation, beyond the genetic data.The essay tries to favor the circulation of the status filiationis, showing how a process of approximation of the legal systems is taking place. This could have an influence on the international scientific community as a function of an increase in the circulation of families and the implementation of fundamental rights.
