Individuals’ decision-making is marked by “bounded rationality.” Agents’ preferences are construed in the moment of choice, choices are restrained by bias and cognitive defects, and often defeat agents’ own ends. ‘Nudges’ are interventions on choice architecture that steer people toward better choices. In this paper I offer some arguments against employing framing effect and default rules to solve conflicts between autonomy and beneficence in obtaining informed consent for medical treatments.

Abstract
