Il saggio affronta il tema della nozione giuridica di genitore a fronte dei nuovi problemi sollevati dalle diverse fattispecie riconducibili alla c.d. “filiazione di fatto”. La più recente legislazione e diverse sentenze inducono a far leva, da un lato, sulla rilevanza giuridica del legame affettivo instauratosi tra il minorenne e il genitore non biologico, dall’altro, sulla relatività del principio del favor veritatis, per argomentare un più complesso ordine pubblico della filiazione e della genitorialità. I casi in cui rileva la figura del c.d. “genitore sociale”, la questione della riconoscibilità in Italia di atti stranieri da cui risultino due figure genitoriali dello stesso sesso e i limiti all’adozione internazionale omosessuale costituiscono un banco di prova, che divide la dottrina, delle tensioni connotanti la nozione di genitore e l’impianto costituzionale. The essay deals with the issue of the juridical notion of parent in the face of the new problems raised by the various cases attributable to the c.d. "Filiation of fact". The most recent legislation and various judgments lead us to take advantage, on the one hand, from the legal relevance of the affective bond established between the minor and the non-biological parent, on the other, on the relativity of the favor veritatis principle, to argue a more complex order subsidiary of parentage and parentage. The cases in which the figure of the c.d. "Social parent", the question of the recognizability in Italy of foreign acts that show two parental figures of the same sex and the limits to international homosexual adoption constitute a test-bed, which divides the doctrine, of the tensions connoting the notion of parent and child constitutional facility.
