This paper analyses the Union’s contribution to the global governance of large flows of migrants and refugees. The analysis considers both the Union’s direct involvement in the negotiations and its indirect contribution deriving from the use of EU cooperative models as a source of inspiration for the solutions adopted in the Global Compacts. This appraisal returns a detailed image of the inconsistencies between the new global governance of mass migrations and the goal – set forth in the New York Declaration – to establish «a more equitable sharing of the burden and responsibility for hosting and supporting the world’s refugees» (para. 68). At the same time, it shows that the features of the EU partnership framework on migration align with a global trend aimed at repositioning aliens’ rights with respect to State control on human mobility. Legal instruments exist in the EU order to avoid further demeaning of the rights of those fleeing en masse. They can and must be mobilised to ensure that the Union’s contribution to the global governance of large flows of migrants and refugees is consistent with EU values, principles and objectives.

Abstract
