La società civile nel Law Making Process

La crisi della rappresentanza politica e della democrazia rappresentativa spinge a riflettere su nuove formule democratiche che rafforzino effettivamente i canali di interazione fra le istituzioni e i cittadini. A tal fine, si assume come parametro valutativo di misura dello “stato di salute” di una democrazia la disciplina di un effettivo coinvolgimento del pubblico nei processi decisionali. Sulla base di questo criterio, il tema della partecipazione della società civile viene ad essere sviluppato, in primo luogo, nel quadro ordinamentale del Consiglio d’Europa. Successivamente, nell’ambito del Consiglio d’Europa, si confronteranno le discipline relative alle forme di partecipazione civile in processi decisionali previste dal Regno Unito e dall’Ungheria. Mentre il Regno Unito si mostra essere sostanzialmente e formalmente aderente al percorso tracciato dal Consiglio d’Europa, l’Ungheria lo è solo formalmente, e non senza problematiche. The crisis of political representation and representative democracy urges us to reflect on the need for new forms of democracy that could strengthen the channels of interaction between institutions and citizens more effectively. For this propose, the degree of involvement of the public in the decision-making processes is taken as a measure of the “the health of a democracy”. On the basis of this criterion, the issue of the regulation of civil society participation is developed in the first instance within the legal framework of the Council of Europe. Within this framework, forms of civil participation in decision-making processes presented by United Kingdom and Hungary will also be debate. It emerges that the United Kingdom’s adherence to the pathway provided by the Council of Europe is both formal and substantial, whereas Hungary’s adherence to this pathway is only formal and is not issue-free.
