THE SUCCESS OF A CONSTITUTIONAL EXPERIMENT: WHEN HISTORY MATTERS. THE ITALIAN CONSTITUTIONAL COURT IN GLOBAL CONTEXT*

The paper moves from the analysis offered by the book “Italian Constitutional Justice in Global Context” to suggest some remarks on the way the Italian Constitutional Court has become, in a relatively short period of time, a strong, stable and respected constitutional actor. In fact, despite having started its activity, in 1956, in a context of real hostility due to the strong role of the Parliament on one side and the weakness of the lower courts (that were supposed to bring cases before the Constitutional Court) on the other side, the new institution was capable to conquer its role by developing cooperative and collaborative relations with both the the legislature and the judiciary. In other word, the adaptive capacity of this institution and its “relationality” has been at the basis of its recognition and its acceptance by the other institutional actors. L’articolo prende spunto dall'analisi offerta dal libro “Italian Constitutional Justice in The Global Context” per suggerire alcuni osservazioni sul modo in cui la Corte costituzionale italiana è diventata in un periodo di tempo relativamente breve, un attore costituzionale forte, stabile e rispettato. Infatti, nonostante abbia iniziato la sua attività, nel 1956, in un contesto di vera ostilità dovuta al forte ruolo del Parlamento, da un lato, e la debolezza dei tribunali inferiori incaricati di portare i casi davanti alla Corte costituzionale, dall'altro lato, la nuova istituzione è stata in grado di conquistare il suo ruolo e di sviluppare relazioni di cooperazione e collaborazione con entrambi, sia il legislatore che la magistratura. La capacità adattativa di questa istituzione e la sua "relazionalità" sono state alla base della sua riconoscimento e accettazione da parte degli altri attori istituzionali.
