Il ragionamento giuridico nell'era dell'intelligenza artificiale

L’impiego dell’intelligenza artificiale influenza ormai ogni aspetto della vita individuale e collettiva e sta mutando con rapidità non solo l’ambito dell’economia, ma anche quello politico e sociale, senza che peraltro si possano ipotizzarne con certezza gli esiti. A fronte di tale travolgente progresso, la riflessione giuridica è ancora in forte ritardo. Il legislatore fatica a inseguire fattispecie mutevoli e sfuggenti e non è chiaro quali strumenti interpretativi ed applicativi possano essere in concreto adoperati dai giuristi. Questa raccolta di scritti si propone per l’appunto di colmare la lacuna, stimolando un percorso di riflessione che ponga nuovamente al centro dell’investigazione il diritto ed i suoi fondamenti. L’obiettivo è quello di esplorare -e se possibile comprendere- come l’uso di macchine e programmi intelligenti possa influenzare il modo con cui si sviluppa e trova compimento il ragionamento giuridico. Si tratta di trovare una sintesi tra lo sviluppo tecnologico ed i principi che guidano dell’attività del giurista, al fine di garantire una adeguata tutela dei diritti / The use of artificial intelligence is now influencing every aspect of individual and collective life and is rapidly changing not only the economic sphere, but also the political and social one, without any certainty as to its outcome. In the face of this overwhelming progress, legal reflection is still lagging far behind. The legislator is struggling to follow changing and elusive cases and it is not clear which interpretative and applicative instruments can be used in practice by the jurists. The aim of this collection of writings is to fill the gap, stimulating a path of reflection that once again places law and its foundations at the centre of the investigation. The aim is to explore - and if possible understand - how the use of intelligent machines and programs can influence the way in which legal reasoning develops and finds fulfillment. It is a question of finding a synthesis between technological development and the principles that guide the activity of the jurist, in order to ensure adequate protection of rights.
