La “ridondanza” nel giudizio di legittimità costituzionale in via d’azione

The essay hereto analyzes the “ridondanza” in the direct judgment of constitutional legitimacy, namely that institution whereby the regional government may rebut the violation of regulations which are different from those contained in Title V of the Constitution, as long as said violation “impacts” the realm of regional assignment, extending therefore the constitutional court’s jurisdiction to matters not directly related to competence. The essay analyzes the theoretical constructions formulated by the doctrine, to explore, in turn, its actual operativity in constitutional jurisprudence, with the aim to rationalize the definition of “ridondanza” in the sense of an unambiguous conceptualization and understand which limit the constitutional jurisprudence has reached, with particular regard to the autonomy, or lack thereof, of the “ridondanza” in relation to the violation of competential regulations.
