Many authors have argued for moral and legal unacceptability of buying and selling human organs. Recently, Roberto Andorno has revived an argument for such a conclusion based on a Kantian conception of human dignity. I try to show that instead we need an empirical conception of dignity and that there are good reasons, relating to the vulnerability of the poor sellers, which lead to a negative moral judgment on organs commodification. Admittedly, such an argument may be not as strong as those based on a “pure” conception of human dignity.

Abstract

Many authors have argued for moral and legal unacceptability of buying and selling human organs. Recently, Roberto Andorno has revived an argument for such a conclusion based on a Kantian conception of human dignity. I try to show that instead we need an empirical conception of dignity and that there are good reasons, relating to the vulnerability of the poor sellers, which lead to a negative moral judgment on organs commodification. Admittedly, such an argument may be not as strong as those based on a “pure” conception of human dignity.
