Rifiuti, beni e proprietà nella prospettiva dell’economia circolare

Il tema dei rifiuti rappresenta una materia che forse piú di altre mostra una stretta connessione tra economia e diritto. La qualificazione giuridica della cosa “destinata allo smaltimento” sconta problemi di tutela dell’ambiente e del valore residuo dei materiali che nella nuova ottica dell’economia circolare, attenta al riutilizzo e alla rivalutazione delle materie prime secondarie, non si accontenta della definizione del rifiuto in termini di non utilità, ma ne propone una nuova definizione di bene giuridico. The theme of waste represents a subject that, more than others, shows a close connection between economy and law. The legal qualification of the thing “destined for disposal” suffers from problems of environmental protection and residual value of the materials which, in the new perspective of the circular economy, attentive to the reuse and revaluation of secondary raw materials, is not satis!ed with the de!nition of waste in terms of not useful, but proposes a new de!nition of legal asset.
