Sobre os assim chamados « Staatsfragmente »

RIASSUNTO In questo testo, il giuspubblicista italiano Santi Roma-no intende confutare la teoria degli Staatsfragmente di Georg Jellinek - frazioni territoriali dotate di alcuni, ma non di tutti, gli attributi dello Stato. Così Romano presenta la teoria di Jellinek e rileva alcuni dei suoi limiti, soprattutto per quanto riguarda gli elementi "classici" della statualità (popolo, territorio, sovrani-tà). Secondo Jellinek, gli Staatsfragmente avrebbero un popolo e un territorio, ma non la sovranità, invece per Romano, gli altri due elementi sarebbero meri riflessi: senza di essa, non c'è Stato. Successivamente confronta la situazione degli Staatsfragmente con le frazioni di Comuni e con le colonie. Questi enti ap-parterrebbero rispettivamente al Comune e allo Stato, privi di qualsiasi individualità. La conclusione di Romano è che le riflessioni di Jellinek sono stimolanti, ma sostanzialmente hanno delle carenze logiche, sono eccessivamente astratte e quindi non dovreb-bero essere adottate dalla teoria del diritto pubblico. RESUMO No presente texto , o juspublicista italiano Santi Ro-mano pretende refutar a teoria de Georg Jellinek acerca dos Staatsfragmente – frações territoriais dotadas de algumas atribuições do Estado, mas não de todas. Romano, para tanto, descreve a teoria de Jellinek e aponta algumas de suas falhas, sobretudo quanto aos três elementos ‘clássicos’ da estatalidade (povo, território, soberania). Para Jellinek, os Staats-fragmente teriam povo e território, mas não sobera-nia, enquanto que, para Romano, os outros dois ele-mentos seriam meros reflexos: sem ela, não há Esta-do. Na sequência, compara a situação dos Staatsfrag-mente com as frações de Comuni e com as colônias. Esses entes pertenceriam respectivamente ao Co-mune e ao Estado, sem qualquer individualidade. Romano conclui que as reflexões de Jellinek são estimulantes, mas, em última instância, têm falhas lógicas, são excessivamente abstratas e não devem ser adotadas pela teoria do direito público. ABSTRACT In this essay, the Italian juspublicistSanti Romano refutes Georg Jellinek's theory of the Staatsfragmente -territorial fractions with some, but not all, of the State's powers. To do so, Romano describes Jellinek's theory and points out some of its flaws, especially re-garding the three 'classical' elements of statehood (people, territory, sovereignty). For Jellinek, the Staatsfragmente would have a people and a territory, but no sovereignty, while for Romano, those two elements would be mere reflections of sovereignty: without it, there is no State. He then compares the situation of the Staatsfragmente with the fractions of Comuni and with the colonies. These entities would belong respectively to the Comune and the State, with no individuality. Romano concludes that Jelline-k's reflections are stimulating, but are ultimately logically flawed, excessively abstract and should not be adopted by public law theory.
