Testamenti suggeriti e invalidità (parziale)

Il saggio è pubblicato su una rivista giuridica di fascia A e si segnala per la rilevanza e l'attualità del problema trattato. Il saggio approfondisce la questione della tutela del testatore vulnerabile, soprattutto nei casi in cui sia un imprenditore, con particolare attenzione al fenomeno dei testamenti c.d. suggeriti. Si tratta di una figura non prevista dal codice civile, di cui il saggio mira a dimostrare la rilevanza giuridica. Dopo aver ricostruito i principali orientamenti esistenti circa il rimedio azionabile, il lavoro valorizza la tesi dell'annullamento del testamento per captazione, riflettendo su una possibile graduazione del rimedio attraverso il modulo della parzialità. Tale soluzione risulta particolarmente efficace per realizzare gli interessi del testatore imprenditore, il quale si avvalga di legati di azienda o di partecipazioni sociali. The essay is published in a law review of class A and it distinguishes for the relevance and the currency of the issue. The essay analyses the issue of the protection of the vulnerable testator, especially in case she/he is an entrepreneur, with particular reference to the phenomenon of the so called suggested will. This latter is a figure which is not regulated by the civil code, but the essay aims at showing that it has a legal relevance. After having provided the main scholars' approaches about remedies, the essay underlines the thesis of invalidation of the will due to captation, reflecting upon a possible graduation of the remedy by-means of the partiality technique. Such solution seems particularly effective to realize the interests of the testator when she/he is an entrepreneur, who disposes special provisions about enterprise or shareholdings.
