La mancata registrazione del contratto di locazione davanti alle Sezioni Unite

Il saggio analizza la recente sentenza delle Sezioni Unite n. 23601/2017, in cui viene affrontata la dibattuta questione del rapporto tra norme privatistiche e norme tributarie, con particolare riguardo alla complessa materia della locazione di immobili adibiti a uso non abitativo.Dopo aver ricostruito il quadro normativo in cui si inserisce questo tema, il saggio si concentra sulla questione specifica delle conseguenze da riconnettere all'omessa registrazione del contratto di locazione dissimulato, nel confronto con la diversa ipotesi in cui l'inadempimento si verifichi al di fuori del fenomeno simulatorio. This paper analyses the recent judgement of the Supreme Court n. 23601/2017, which examines the discussed issue of the relationship between Private Law rules and Fiscal Law rules, with particular regard to the complex matter of leasing contract for non-residential buildings. After having described the regulatory framework related to this theme, the essay focuses on the specific issue of the effects product by the omitted registration of the mocked leasing contract, in the comparison with the different case of the breach of non mocked contracts.
