The comment deals with the possible consequences on exequatur proceedings against foreign States of the decision of the Italian Constitutional Court No. 238/2014, which denied State immunity when facing with delicta imperii. Attention is focused on the differences to be taken into account, when evaluating the risk of denial of justice of the victims, when facing exequatur proceedings, a matter that was not the object of decision No. 238/2014 by the Constitutional Court and still remains uncertain.
