Migrantes ambientales en el sistema legal italiano: herramientas de protección y perspectivas de inclusión laboral

Este trabajo analiza las formas de inclusión laboral de las personas inmigrantes ambientales, que en la actualidad solo están limitadamente atendidas por el sistema legal italiano. Resulta especialmente interesante la fórmula italiana de reconocimiento de la protección internacional para estas personas, que representa el primer paso en el camino hacia su integración laboral. En este sentido, por un lado, se ha intentado – aunque sin resultados plenamente satisfactorios, hasta el momento – adaptar, a menudo en los tribunales, los instrumentos clásicos de protección internacional (y, en particular, la protección humanitaria y especial) a las necesidades de las personas migrantes ambientales. Por otro lado, se han creado instrumentos legales ad hoc, como el permiso de residencia por desastres naturales. The essay analyses the ways for labour inclusion of environmental migrants, which at present are only limitedly satisfied by the Italian legal system. With reference to the recognition of international protection for environmental migrants, which represents the first step on the road to labour inclusion, the Italian perspective appears particularly interesting. Here, in fact, on the one hand, an attempt has been made – albeit without fully satisfying results, up to now – to adapt, often in Courts, the classic international protection tools (and, in particular, humanitarian and special protection) to the needs of environmental migrants. On the other hand, ad hoc legal instruments, such as the residence permit for natural disasters, have been created.
