Modello costituzionale e trasformazione del sistema delle fonti nelle crisi economica e pandemica. Emergenza e persistenza

This essay will address the most important dichotomy that the conference title suggests, that is, 'emergencies/persistencies'. A combination that refers to the need to distinguish, in the transformations that practice has imposed on the 'constitutional model', long-term trends from the phenomena triggered by the economic crisis and the pandemic. Based on these considerations, the initial part of this contribution (Section I) will be devoted to an attempt to clarify whether the 'constitutional model' of the 'system of sources' accepted by the Constituents in 1948 exists and what its structural and founding characteristics are. This will be followed by a central body of reflection in which an attempt will be made to analyze what evolutions and changes the system of sources has undergone in the more than 70 years of the history of our Republic (Section II) and to give an overall reading from the point of view of the levels of normative production and the incidence of the external factors that have conditioned it (Section III).
