Labour in the Constitution: Social pluralism and the unity of the legal system in the thought of Costantino Mortati - The essay follows the scientific path of Costantino Mortati from the 1930s to the 1970s, from corporatism to the republican Constitution, considering the role attributed to labour in affirming a «substantial» union between society and state, between pluralism and unity. Mortati’s entire scientific activity is marked by the problem of the modern state crisis, by the need to overcome the individualistic fragmentation of the liberal state to achieve a legal order capable of effectively uniting an increasingly articulated and complex society. In Mortati’s thought, by recognizing social pluralism the republican Constitution ‘founded on labour’ made the need for social homogeneity more pressing and required to identify legal instruments of integration capable of holding together consistently social pluralism and the unity of the legal system.
