Excarcelaciones fáciles o conciencia colectiva? Una crítica garantista de la antimafia tradicional en Italia

The crisis triggered by the COVID emergency also affected the penitentiary sphere, causing, in March 2020, several episodes of discontent in various prisons throughout the country. This contribution is intended to be a reflection on the close link that has existed, for thirty years now, between the movement, policies and discourses on the anti-mafia on the one hand and criminal justice on the other. Starting from emergencies as the glue of Italian politics and society, we will try to examine the relationship between anti-mafia and justicialism trying to show how the emergency measures, in particular the 41 bis and the life imprisonment, in addition to not being effective on the plan of the fight against criminal organizations, have the double effect both of creating a cohort of moral entrepreneurs and of reproducing the violations of human rights that justicialism entails, both directly, towards those sentenced to 41 bis and life imprisonment, and indirectly, towards the inmates.
