The author analyses the provisions of Directive 2019/1158/EU on flexible working arrangements for parents and caregivers, comparing them with the transposing regulations introduced by Legislative Decree No. 105/2022.The analysis highlights the most relevant differences between the two laws, proposing some solutions by way of interpretation. Lastly, the author dwells on the interference between the rules introduced by Legislative Decree No. 105/2022 and the notion of discrimination outlined in Law No. 162/2022.
