Tratta di persone e intermediazione illecita di manodopera: due fattispecie per lo stesso crimine?

This article offers a critical analysis of the crime of illegal brokering and labour exploitation within Italian criminal law, aiming to qualifying it as a specific form of trafficking of human being. In particular, a comparison between the legal structure of the crime of trafficking in human beings and that of the crime of illegal brokering and labour exploitation is carried out. In addition, similarities between the two dispositions are assessed from a legal-sociological perspective. After a detailed overview of the Italian jurisprudence, it is argued that the crime of illegal brokering should be eliminated as a specific offence to make room for the application of trafficking in human beings.
