Con la sentenza C-24/21 la Corte di giustizia torna nuovamente sul tema della coesistenza e sembrerebbe dichiarare la conformità al diritto europeo di leggi nazionali che consentono di creare zone OGM free, pur in assenza di notifiche alla Commissione. Dopo aver ripercorso i precedenti orientamenti della Corte, lo scritto si sofferma sull’interpretazione dell’art. 26 bis della Dir. (CE) 18/2001 e sul ruolo svolto dalla Commissione, in attesa di una riforma organica della materia. In judgment C-24/21, the CJEU returns once again to the issue of coexistence and declares a national regulation, that allows GMO-free zones even without notification to the Commission, in compliance with the EU law system. After recalling the CJEU's previous rulings, the paper focuses on interpreting Article 26a of Dir. (EC)18/2001 and the role played by the Commission, while awaiting an organic reform of the subject.
