L'Unione europea e la lotta alla disinformazione

Questo saggio analizza le strategie giuridiche adottate dagli Stati e dall’Unione europea per contrastare la disinformazione online. Sicché vuole chiarire, anzitutto, che cosa si intende per disinformazione, che sembra assumere una fisionomia giuridica sempre più autonoma. In seconda battuta, l'articolo passa poi ad analizzare specificamente le misure adottate dalla UE per combatterla. Tra di esse viene a essere analizzata in particolare la legge UE sui servizi digitali per due motivi in particolare. Anzitutto perché questa legge incide sulla moderazione dei contenuti. In secondo luogo perché si vuole verificare l'impatto di questo nuovo assetto regolatorio europeo, per un verso, sulle discipline dei suoi Stati membri e, per altro verso, sui sistemi predisposti dai prestatori dei servizi di intermediazione della società digitale, in particolare quelli di dimensioni molto grandi. This essay analyses the legal strategies adopted by the European Union and States to to counter online disinformation. First, it seeks to clarify what is meant by disinformation, which seems to be taking on an increasingly autonomous legal character. Secondly, the article deals with the measures taken by the EU to combat it. Among these, the EU Digital Services Act is analysed for two main reasons. First, because this act affects content moderation. Secondly, because we want to examine the impact of this new European regulatory framework, on the one hand, on the disciplines of its member states and, on the other hand, on the systems set up by the intermediary service providers of the digital society, especially the very large ones.
