Constitutional Court judgment n. 171/2022, concerning the right for pharmacies and not for parapharmacies to carry out anti covid-19 tests, is based on the contrast between health and private economic initiative. Nevertheless, a deeper consideration of principles of proportionality and reasonableness as judgement parameters could have shown the lack of risks for health due to competition rules.
