The essay aims at reconstructing the state of the art of jurisprudence on the subject of surrogacy and public order as a limit to the recognition of the foreign act certifying intentional parenting in the event of surrogacy. The analysis will investigate the extent of the recent constitutional intervention on the subject with decision n. 33/2021, as well as any critical aspects of the inadmissibility declaration, to then assess whether the Court could have used alternative decision-making techniques, able to guarantee greater protection for the interests of the child in order to solicit rapid intervention by the legislator.
