Istruzione stragiudiziale nella negoziazione assistita da avvocati. Nuova sfida culturale per il legislatore italiano e metodi complementari di risoluzione delle controversie

The article focuses on the analysis of the extrajudicial instruction introduced in the “negoziazione assistita da avvocati” by the recent reform of civil procedure implemented by the legislative decree 10 October 2022, n. 149 in execution of the l. d. 216 November 2021, no. 206. The institute, which at first glance shows undeniable similarities with some typical remedies of the US pre-trial discovery, is examined both in a strictly internal and comparative key in the light of other experiences of collaborative law both inside and outside the process, with particular reference to the french system.
