The discussion surrounding homo eiusdem condicionis et professionis is used as a case study for showing two different attitudes towards metaphors in Italian juridical science. On the one hand, some scholars have criticised this tool. On the other hand, other scholars have pointed at its creative nature and link with the productive function of language. Both sides agree, though, that progressive abstraction seems to be the current trend in contemporary law.
