Lo sport in Costituzione

Recentemente è stato approvato il disegno di legge costituzionale che include lo sport nella Costituzione italiana. Accolto con grande favore, l’art. 33 afferma che «la Repubblica riconosce il valore educativo, sociale e di promozione del benessere psicofisico dell’attività sportiva in tutte le sue forme». Si tratta di una scelta precisa di valori, le cui basi richiedono un esame approfondito. Il saggio si propone di analizzare la riforma costituzionale e di avanzare alcune riflessioni critiche sulle implicazioni giuridiche e culturali sui seguenti argomenti: la natura dello sport, la concezione del sistema sportivo e la Costituzione stessa. / Recently, the constitutional bill that includes sport within the Italian Constitution has been approved. Welcomed with general acclaim, the amended Art. 33 states that «The Republic recognizes the educational, social and promotion value of psychophysical well-being of sporting activity in all its forms». A precise choice of values is involved, whose foundations require an in-depth examination. The essay aims at analyze the constitutional reform and moves forward some critical reflections about the legal and cultural implications on the following topics: the nature of sport, the conception of the sports system and the Constitution itself.
