Alcune riflessioni sull’adozione di Severo Alessandro

Il saggio ripercorre le adozioni di Severo Alessandro e quella precedente di Clodio, interrogandosi sulla loro discussa legittimità a causa del mancato rispetto del principio dell’adoptio naturam imitatur. La legittimità di entrambe le adozioni trova giustificazione in motivi diversi: nella mancanza di una regola giuridica ai tempi di Clodio e nei cambiamenti maturati col Principato che ebbero inevitabilmente conseguenze anche in tema di adozione e quindi anche in quella di Severo Alessandro. The essay retraces the adoptions of Severus Alexander and the previous one of Clodius, questioning their disputed legitimacy due to the failure to respect the principle of adoptio naturam imitatur. The legitimacy of both adoptions is justified by different reasons: in the lack of a legal rule at the time of Clodius and in the changes that arose with the Principate which inevitably had consequences also in terms of adoption and therefore also in that of Severus Alexander.
