Il lavoratore sportivo: definizioni e tipologie contrattuali alla luce della riforma

Il saggio, partendo dalla complessità del sistema normativo relativo al lavoro sportivo in Italia, approfondisce alcuni aspetti della riforma - in particolare del D.Lgs. 36/2001 - volti a sistematizzare il rapporto di lavoro nel settore sportivo in modo organico e paritario. A tal fine, infatti, il decreto crea una disciplina del rapporto di lavoro “variabile” che tiene conto della natura subordinata, autonoma o parasubordinata della prestazione, nonché del contesto in cui si svolge l’attività sportiva (professio- nistico, dilettantistico, volontario). Il discrimen fra ciò che sta nell’area del lavoro e ciò che sta al di fuori di questa non ruota più intorno alla distinzione fra dilettanti e professionisti il cui sinallagma con- trattuale è uguale - ma fra lavoratore sportivo e “volontario” ossia una figura che si pone fuori dal perimetro del diritto del lavoro in ragione della causa solidaristico-sociale che contraddistingue la prestazione. The essay, starting from the complexity of the normative system concerning sports labor in Italy, delves into some aspects of the reform - particularly Legislative Decree no. 36/2001 - aimed at systematizing the labor relationship in the sports sector in an organic and balanced way. To this end, indeed, the decree establishes a discipline of the “variable” labor relationship that takes into account the subordinate, autonomous,or parasubordinate nature of the performance, as well as the context in which the sports activity takes place (professional, amateur, voluntary). The distinction between what lies within the realm of labor and what lies outside it no longer revolves around the distinction between amateurs and professionals whose contractual synallagma is the same - but between the sports worker and the “volunteer”, that is a figure that falls outside the scope of labor law due to the solidaristic-social cause that distinguishes the performance.
