Il Presidente del Consiglio nella legge “Calderoli” prima e dopo la sent. n. 192/2024

The paper describes, in light of Law No. 86/2024 and Constitutional Court ruling No. 192/2024, the prerogatives of the President of the Council of Ministers and of the Minister without portfolio for Regional Affairs and Autonomies in the process of defining and implementing the agreements referred to in Article 116, paragraph 3, of the Constitution. Before the intervention of the Court, Law No. 86/2024 – consistent with developments in the national form of government – clearly emphasized the role of the Presidency of the Council of Ministers, while the roles of the Council of Ministers on the one hand, and of Parliament on the other, were far more limited. However, despite the essential clarifications provided in Judgment No. 192/2024, several significant issues remain unresolved, which are analyzed in the text.
