CONSIDERAZIONI SULLA LEGITTIMAZIONE AD AGIRE DELLE ASSOCIAZIONI DAVANTI ALLA CORTE EDU IN DUE RECENTI PRONUNCE IN MATERIA DI CAMBIAMENTO CLIMATICO E DANNI AMBIENTALI GRAVI E DIFFUSI

Questo contributo discute criticamente le conclusioni alle quali è giunta la Corte europea dei diritti umani in merito alla legittimazione ad agire delle associazioni in due recenti sentenze: Klimasenierinnen e Cannavacciuolo. Il contributo mette in discussione la distinzione tra il cambiamento climatico e il diffuso e grave degrado ambientale che la Corte ha stabilito per giustificare le diverse conclusioni raggiunte in queste due pronunce; sottolinea l'uso incoerente che la Corte ha fatto del consenso europeo per lo stesso scopo. L'articolo riflette anche sulle conseguenze dell'utilizzo del consenso europeo per interpretare i criteri di ammissibilità previsti dalla Convenzione e sull'effetto dell'allineamento che esso ha tra la legittimazione ad agire delle associazioni negli ordinamenti giuridici interni e davanti alla Corte, che alimenta un dialogo senza precedenti tra diversi ordinamenti giuridici. This contribution critically discusses the different findings of the European Court of Human Rights as regard the locus standi of associations in two recent judgments: Klimasenierinnen and Cannavacciuolo. The con-tribution challenges the distinction between climate change and the widespread and serious environmental degradation the Court established to justify its different findings; it underlines the incoherent use the Court made of the European consensus for the same purpose. The article also reflects on the consequences of using the European consensus to interpret the admissibility criteria provided by the Convention and the effect of alignment it has between the associations’ locus standi in the domestic legal systems and before the Court, which nourishes an unprecedented dialogue between different legal orders.
