Nuove tutele in tema di segretezza delle comunicazioni difensive e di intercettazioni

L’iperproduzione normativa difficilmente genera frutti di qualità. Ne è conferma la legge 9 agosto 2024, n. 114: frustrati da una tecnica di redazione approssimativa, i buoni propositi del legislatore hanno lasciato tracce sbiadite nell’ordito normativo. A fronte di previsioni dal contenuto incerto, se non inutile, l’analisi ambisce a ricostruire la portata dell’intervento volto a tutelare i diritti fondamentali coinvolti da attività investigative intrusive: la segretezza delle comunicazioni con il difensore, da un lato, la riservatezza dei soggetti intercettati, dall’altro. Faced with provisions of uncertain, if not useless, content, the analysis aims to retrace the scope of the legislative intervention to protect the fundamental rights involved in intrusive investigative activities: the secrecy of communications with the defence counsel, on the one hand, the confidentiality of intercepted subjects, on the other.
