Muovendo dalla recente pronuncia della Corte di giustizia dell'Unione europea (grande sezione, sent. 21 dicembre 2023, causa C-281/22, G.K. e altri), il contributo illustra le problematiche sottese al nuovo meccanismo di cooperazione giudiziaria sui generis introdotto dall'art. 31 reg. UE/2017/1939. Ampio spazio è dedicato alle ricadute interne generate da un simile assetto. Starting from the recent ruling of the EU Court of Justice (Grand Chamber, judgment of 21 December 2023, case C-281/22, G.K. and others), the paper illustrates the issues underlying the new sui generis judicial cooperation mechanism introduced by Article 31 of Regulation (EU) 2017/1939. Ample space is devoted to the internal repercussions generated by such an arrangement.
