The article analyses a request for an advisory opinion submitted by the Supreme Court of Ukraine to the European Court of Human Rights under Protocol No. 16 to the ECHR. The request stems from a dispute between a monastery of the Ukrainian Greek Catholic Church and a ‘former nun’ who claims the right to return to live in a monastic cell, and raises two questions of principle: whether monastic cells can be classified as ‘home’ within the meaning of Article 8 of the Convention and the extent of the jurisdiction of civil courts in disputes based on terminated religious relationships.
