STATO DI EMERGENZA E DITTATURA ROMANA: QUALCHE RIFLESSIONE A PARTIRE DAL ‘CONTRAT SOCIAL’ DI J.-J. ROUSSEAU

Inserito nell’ambito di una più ampia riflessione sullo stato di emergenza, il contributo ripercorre i principali snodi del capitolo VI del libro IV del Contrat social di Jean-Jacques Rousseau, in cui il tema della dittatura, pur affrontato mediante categorie talvolta distanti dal sistema giuridico romano, è trattato ricalcando i contorni della suprema magistratura straordinaria cui si faceva ricorso nella Roma repubblicana in presenza di circostanze eccezionali, poi caduta in desuetudine a partire dalla fine del III secolo a.C. Placed within a broader inquiry into the state of emergency, this contribution examines the core aspects of Chapter VI of Book IV of the Contrat social by Jean-Jacques Rousseau. It shows how the notion of dictatorship, while articulated through conceptual categories that do not always align with the Roman legal framework, is nonetheless shaped in close dialogue with the model of the supreme extraordinary magistracy resorted to in Republican Rome in times of exceptional necessity, an institution that gradually fell into disuse from the late third century BCE onward.
