The contribution focuses on the analysis of the AI Act as a regulatory framework aimed at balancing the need for technological development, capable of ensuring greater efficiency and well-being, with the protection of fundamental rights, whose potential risks and appropriate mitigation measures must be identified, in order to prevent public decision-making from being entrusted exclusively to the “thinking machine,” an expression of a mechanism of indifferentiation that, through mathematical-computational logic, flattens individual identities and social complexity into data, however numerous they may be.
