The article comments on Council of State ruling no. 1510/2022, which recognised the legitimacy of the measures aimed at relocating the fresco depicting the Madonna del Parto inside the chapel of Santa Maria a Momentana, where it was painted by painter Piero della Francesca. The analysis of the decision allows us to reflect on the relevance of the relationship between the artistic work and the environmental and social context for the purposes of the declaration of cultural interest and the choice between different methods of protection and valorization.
