L'articolo verte su due pronunce emesse dalla Corte europea dei diritti dell'uomo: l'una in materia di accertamento della responsabilità civile sui medesimi fatti oggetto di un procedimento penale conclusosi con sentenza di proscioglimento; l'altra in materia di dovere di motivazione effettiva e non stereotipata che grava sul giudice. The article focuses on two judgments handed down by the European Court of Human Rights: one concerning the determination of civil liability in relation to the same facts that were the subject of criminal proceedings which ended in an acquittal; the other concerning the duty on the court to provide effective and non-formulaic reasoning.
