Trascrizione tardiva del matrimonio concordatario e responsabilità. Spunti in tema di abuso del diritto

La Cassazione qualifica come non antigiuridico il diniego del coniuge alla trascrizione tardiva del matrimonio concordatario, valorizzando l'attualità della volontà richiesta dall'art. 6, l. n. 121/1985. Ricostruita la natura autonoma della trascrizione tardiva e la sua connotazione volontaristica nel regime neoconcordatario, il contributo si interroga sull'esclusione dell'illiceità del diniego, tenendo conto anche della possibile rilevanza di una sua connotazione abusiva. The Italian Supreme Court holds that a spouse’s refusal to consent to the late civil registration of a concordat marriage is not wrongful, emphasising the requirement of a current and actual will under Art. 8 of Law No. 121/1985. After reconstructing the autonomous nature of late registration and its voluntaristic character in the post-1984 concordat regime, the paper examines the exclusion of unlawfulness and considers the potential relevance of an abusive exercise of the refusal.
