Regole successorie e continuità dell'impresa

This essay offers a wide and critical interpretation on those rules of the italian Civil Code established in the so called "Libro II" ("Book Two") wich seem to be in conflict with the typical economic and financial goals of a company: efficiency and stability. Among the legal solutions which the business-owner have to plan the "transfer of family business", the Autor focuses his analysis on two different kinds of solution: the first one is about those "company rules" wich were "the best practice" until now; the second one concerns the "Family pact" Law wich was recently introduced in the italian legal system as an alternative opportunity to manage the "trasfer". But the "Family pact" Law is so difficult to apply that the Autor doesn't think it will be widespread used in the typical italian way to capitalism: the "family business".
