Famiglie e matrimonio: profili evolutivi nel diritto europeo

Istituti caratterizzanti il diritto di famiglia sono stati oggetto di un processo evolutivo ancora in atto. Il diritto europeo e internazionale e la giurisprudenza della Corte di Lussemburgo e di Strasburgo hanno inciso sulla nozione di matrimonio, sulla costituzione del rapporto di filiazione, sui diritti dei conviventi more uxorio e sulla procreazione medicalmente assistita. Ciò ha determinato un avvicinamento delle legislazioni dei diversi Stati membri dell’Unione europea. La diversità di sesso quale elemento non più essenziale del matrimonio, l’affermarsi dell’unicità dello stato di figlio, l’assunzione di responsabilità quale fondamento del rapporto di filiazione e il diritto di avere un figlio sono aspetti ampiamente condivisi in Europa. Non mancano, tuttavia, tra le normative statuali significative distinzioni, le quali hanno reso sempre più urgente la questione di un possibile diritto europeo della famiglia. L’Italia non ha ancora affrontato adeguatamente, sul versante legislativo, problemi oramai pressanti che interessano la posizione giuridica del convivente, la procreazione eterologa e la diagnosi preimpianto. Senza tacere, in prospettiva de iure condendo, del matrimonio tra persone delle stesso sesso, anche con riguardo a quello contratto all’estero, e dell’adozione da parte della coppia non sposata anche dello stesso sesso. Institutions that characterize the family law have been the subject of an evolutionary process still in progress. The European and international law and the jurisprudence of the Court of Luxembourg and Strasbourg have impact on the concept of marriage, on the establishment of parent-child relationship, the rights of cohabiting partner more uxorio and on medically assisted procreation. This has led to a rapprochement between the laws of different Member States of the European Union. The diversity of sex which is not the most essential element of marriage, the affirmation of the uniqueness of the rule of his son, the assumption of responsibility as the foundation of the parent-child relationship and the right to have a child aspects are widely shared in Europe. There are, however, significant distinctions between the laws state actors, which made it all the more urgent the issue of a possible European law of the family. Italy has not yet adequately addressed, on the legislative side, now the pressing issues that affect the legal position of cohabiting partner more uxorio, the heterologous procreation and preimplantation diagnosis. Without silence, in the iure condendo perspective, marriage between persons of the same sex, even with regard to that contract abroad, and the adoption by unmarried couples, also of the same sex.
