Riconoscimento della voce e indagini atipiche della polizia giudiziaria: la tutela dell’autodeterminazione dell’imputato

La sentenza in esame, espressione dell’orientamento giurisprudenziale che sostiene il principio di atipicità degli atti di indagine della polizia giudiziaria, afferma la legittimità del riconoscimento della voce dell’indagato operato dalla persona offesa. In particolare, l’atto d’indagine atipico, in cui si concretizza la richiesta all’indagato di proferire alcune espressioni verbali, pure in assenza del difensore, non è ritenuto lesivo della libertà morale. In questa prospettiva una prima lettura della pronuncia desta perplessità; tuttavia la riflessione sul rapporto tra tutela della libertà morale dell’imputato e contributo dello stesso all’accertamento del fatto rivela la correttezza, in linea di principio, dell’interpretazione offerta dalla Suprema Corte. The judgment under review, expression of the juridical orientation that supports the principle of atypicality of the acts of investigation led by the police, affirms the legitimacy of the defendant's voice recognition operated by the injured. In particular, the atypical investigative act, in which the request for the accused of saying some verbal expressions can be materialized, even in the absence of the defence attorney, is not considered detrimental to the moral freedom. In this perspective, a first reading of the judgment arouses perplexity; however, the reflection on the relationship between the protection of the moral freedom of the accused and the contribution of the same for the ascertainment of the fact reveals the correctness of the interpretation offered by the Supreme Court.
