The article aims to analyze the process of institutionalization of civil and commercial mediation, and in particular to understand how the relationship between mediators and lawyers is configured. What we propose is to frame this process within a dialectic between established and outsiders, but without restricting to (and falling in line with) a search of winners and losers. Our greater interest and our purpose, indeed, is trying to identify the possible configurations assumed by the relations between professions, as a result of the introduction of mandatory mediation in civil justice.
