La legge 28 aprile 2014, n. 67 ha inciso profondamente su alcuni snodi centrali del processo penale. La riforma più importante ha eliminato la contumacia e ha creato due nuovi istituti: la sospensione del processo per irreperibilità dell'imputato e l'assenza "consapevole". Il volume delinea i tratti principali degli istituti e affronta le più importanti questioni relative alla disciplina del processo penale contro l'imputato irreperibile. Alla ricostruzione dell'evoluzione storica della normativa sull'irreperibilità segue l’esame della giurisprudenza della Corte europea dei diritti dell'uomo; quindi sono affrontati i problemi che le modifiche legislative hanno provocato fino all'entrata in vigore della riforma del 2014. Una volta ridefiniti i contorni del diritto dell'accusato a partecipare al proprio processo, si è proceduto ad un'analisi organica delle nuove norme al fine di valutarne gli aspetti di frizione con i princìpi costituzionali e convenzionali. Messe in luce le criticità delle nuove disposizioni, di queste viene proposta una lettura funzionale che permetta di trovare un bilanciamento tra la tutela dei diritti dell'imputato e l'efficienza della macchina giudiziaria. The most important reform has eliminated the old "contumacia" and created two new institutions: the suspension of the trial for the untraceable defendant and the "conscious" absence. The book outlines the main features of the institutes and addresses the most important issues related to the discipline of the criminal trial against the untraceable defendant. The reconstruction of the historical evolution of the legislation in this field is followed by the examination of the case law of the European Court of Human Rights; then the volume covers the problems that legislative changes have caused until the entry into force of the reform of 2014. Once redefined the contours of the right of the accused to participate in his own process, a thorough analysis of the new rules is carried out in order to assess the aspects of friction with constitutional and conventional principles. Once the critical aspects of the new provisions have been highlighted, it is proposed a functional reading that could be helpful in order to to rebalance the guarantees of the accused and the need of justice.
