The article describes the manner in which international criminal tribunals interpreted, applied and developed customary international law. It argues about the prominence of opinio iuris in the formation of customary rules in the field of International humanitarian law and international criminal law, through the analisys of case-law and reference to the theories of Antonio Cassese and René-Jean Dupuy.
